Terms of Use

The rules that keep Ultrasound Fanatic’s website, resources, and POCUS Simulator clear, responsible, and built for education.

These Terms of Use (the “Terms”) are a binding agreement between you and Ultrasound Fanatic, Inc. (“Ultrasound Fanatic,” “we,” “us,” or “our”). They govern your access to and use of ultrasoundfanatic.com, POCUS Simulator, our educational content, communications, and related services (collectively, the “Services”).

Important clinical boundary

The Services are educational tools—not medical advice, a diagnostic service, a medical device, a substitute for supervised scanning, or proof of clinical competency or credentialing.

1. Agreement to these Terms

By accessing or using the Services, creating an account, or completing a purchase, you agree to these Terms and acknowledge our Privacy Policy and Disclaimer. If you do not agree, do not use the Services.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. “You” then includes both you and the organization.

2. Eligibility and accounts

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. The Services are not directed to children under 13.

When an account is required, you agree to provide accurate information, keep your credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account except to the extent caused by our failure to use reasonable security measures.

Accounts are personal unless an organizational or team license expressly permits shared or managed access. You may not sell, transfer, or lend your account.

3. Educational use only

The Services support ultrasound education, simulated case rehearsal, image-recognition practice, and review of general information. They do not provide patient-specific recommendations and must not be used to diagnose, treat, monitor, or manage a patient.

  • Always use independent clinical judgment and follow applicable laws, institutional policies, protocols, scope-of-practice limits, and supervision requirements.
  • Simulation performance, scores, completion, or app use do not establish competency, certification, credentialing, privileging, or readiness for independent practice.
  • Real image acquisition requires supervised, hands-on practice and appropriate clinical oversight.
  • Do not delay emergency care or professional consultation because of anything in the Services.

4. Limited license and ownership

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for lawful educational purposes. If you download the app, the license is for use on devices you own or control and remains subject to the applicable app-store rules.

The Services—including software, simulations, cases, text, graphics, videos, branding, interfaces, compilations, and other content—are owned by Ultrasound Fanatic or our licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are transferred to you.

You may quote brief portions of publicly available material with clear attribution when permitted by law. You may not copy, scrape, reproduce, sell, publish, distribute, create derivative works from, or commercially exploit the Services without written permission.

5. Purchases, trials, and subscriptions

Some features may require a one-time purchase or automatically renewing subscription. The price, billing period, included features, trial terms, and any recurring-charge disclosure shown at checkout form part of these Terms.

Automatic renewal

If you start an auto-renewing subscription, the store or payment provider will charge the payment method associated with your account at the stated interval until you cancel. Cancel before the renewal deadline shown by that provider to avoid the next charge.

App-store billing

Apple App Store and Google Play purchases are billed, renewed, canceled, and refunded under the rules and account controls of the applicable store. We do not receive your full payment-card number. Deleting the app or your Ultrasound Fanatic account does not necessarily cancel an app-store subscription.

Changes and refunds

We may change future pricing or features with notice required by law or the applicable store. Except where required by law or the payment provider’s policy, charges are non-refundable and partial subscription periods are not credited. Taxes may apply.

6. Your content and feedback

If you send us feedback, support requests, comments, or other material, you retain ownership of content you lawfully own. You grant us a worldwide, royalty-free license to use, reproduce, modify, and display that material as reasonably necessary to provide support, operate and improve the Services, comply with law, and protect our rights.

Feedback and suggestions may be used without restriction or compensation, provided we do not publicly identify you without permission.

Do not submit protected health information, identifiable patient data, or confidential employer information. The Services are not designed as a clinical record system or a channel for patient-care communications.

7. Acceptable use

You agree not to:

  • use the Services unlawfully, fraudulently, or in a way that violates another person’s rights;
  • submit patient-identifiable information, malware, harmful code, or unlawful, deceptive, defamatory, or infringing material;
  • probe, scan, test, bypass, disable, or interfere with security, access controls, rate limits, or technical restrictions;
  • reverse engineer, decompile, or attempt to extract source code except where applicable law expressly permits it;
  • use bots, scraping, data mining, or automated means to copy content, train a model, build a competing dataset, or burden the Services without written permission;
  • impersonate another person, misrepresent affiliation, share credentials, or access an account without authorization; or
  • use the Services to make or automate a clinical diagnosis or patient-care decision.

8. Third-party services, products, and affiliate links

The Services may link to app stores, publishers, course providers, device manufacturers, professional organizations, studies, and other third-party resources. Third parties control their own offerings, terms, privacy practices, availability, and claims. A link does not transfer responsibility for those services to us.

Some recommendations or product links may be affiliate links. If you buy through one, we may earn a commission at no additional cost to you. Material relationships should also be disclosed clearly near the relevant recommendation. See our affiliate disclosure.

POCUS Simulator is an Ultrasound Fanatic product developed with an external development partner and distributed through third-party app stores. Store and partner terms may also apply to the portions they operate.

9. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Services, you acknowledge those practices. You are responsible for ensuring that any information you provide may lawfully be provided to us.

10. Suspension and termination

You may stop using the Services at any time. You may request account deletion as described in the Privacy Policy; deleting an account does not automatically cancel a store-managed subscription.

We may suspend, restrict, or terminate access when reasonably necessary to protect the Services or others, investigate suspected misuse, comply with law, address nonpayment, or enforce these Terms. Where practical, we will provide notice and an opportunity to correct the issue.

Provisions that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms—will survive.

11. Disclaimers of warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Ultrasound Fanatic and its licensors disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and results.

We do not warrant that content is complete, current, error-free, or suitable for a particular clinical setting; that the Services will be uninterrupted or secure; or that using them will produce a particular educational, professional, or clinical result. Nothing in these Terms excludes a warranty that cannot legally be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Ultrasound Fanatic and its officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill, arising from or related to the Services.

To the fullest extent permitted by law, our total aggregate liability for all claims arising from or related to the Services will not exceed the greater of (a) US $100 or (b) the amount you paid to Ultrasound Fanatic for the affected Service during the 12 months before the event giving rise to the claim.

These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not permit certain exclusions or limits, so those provisions apply only to the maximum extent allowed. Nothing limits liability that cannot lawfully be limited.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Ultrasound Fanatic and its officers, directors, employees, contractors, affiliates, and licensors from third-party claims, damages, losses, and reasonable costs arising from your unlawful use of the Services, your content, or your material violation of these Terms or another person’s rights. We will give reasonable notice of a covered claim and may control its defense.

14. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state courts located in Lee County, Florida, or the United States District Court for the Middle District of Florida, and each party consents to personal jurisdiction there.

If mandatory consumer-protection law in your place of residence gives you rights or permits a different forum that cannot be waived, those rights remain available to you.

15. Changes to the Services or these Terms

We may update the Services and these Terms. We will post the revised Terms and update the date above. If a change materially affects your rights, we will provide additional notice when required by law. Changes apply prospectively from their stated effective date. Your continued use after that date means you accept the revised Terms.

16. General provisions

These Terms, together with the Privacy Policy, Disclaimer, checkout terms, and any service-specific terms, are the entire agreement about the Services. If a provision is unenforceable, it will be modified only as much as necessary and the rest will remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, asset transfer, or by operation of law. Headings are for convenience only. Electronic notices satisfy written-notice requirements where permitted by law.
