Privacy Policy

1. Scope and who is responsible

This Policy applies when we determine why and how personal information is processed through the Services. It does not govern a third party’s independent practices, including an app store, linked website, course provider, device manufacturer, social platform, or payment provider.

POCUS Simulator is an Ultrasound Fanatic product developed with Infuse Medical and may be distributed through accounts operated by Infuse Media Group, LLC. Those entities, Apple, Google, and other providers may process information for their own purposes under their own notices. We describe our disclosures to them below.

2. Information we collect

The information collected depends on how you use the Services. In the preceding 12 months, the following categories may have been collected:

Information we do not want you to provide

Do not upload or send patient names, medical-record numbers, images containing patient identifiers, protected health information, or other sensitive clinical data. Unless we separately agree in writing, the Services are not a HIPAA clinical system and we do not offer a business associate agreement for ordinary use.

3. Where information comes from

• Directly from you when you create an account, subscribe, contact us, submit feedback, or choose settings.
• Automatically from your device through logs, cookies, analytics tools, app events, and similar technologies.
• From app stores and payment providers when they confirm a purchase, subscription, cancellation, or refund.
• From service providers that help us host, secure, measure, maintain, and support the Services.
• From public or professional sources if you contact us in a professional capacity or we need to verify a public business relationship.

4. How we use information

• provide, personalize, maintain, and improve the Services;
• create accounts, authenticate users, save progress, and manage access;
• process subscription entitlements and restore purchases;
• respond to support, feedback, privacy, and correction requests;
• send service messages and, with any required permission, educational or marketing communications;
• measure performance, diagnose errors, develop features, and understand aggregate use;
• protect users and the Services, prevent fraud or abuse, and enforce our Terms;
• comply with law, resolve disputes, and maintain appropriate records; and
• create deidentified or aggregated information that is not reasonably linked to an individual.

Automated decisions

We do not use personal information to make decisions based solely on automated processing that produce legal or similarly significant effects. App scores and feedback are educational features, not employment, credentialing, insurance, or clinical decisions.

5. How we disclose information

We may disclose relevant information to the following categories of recipients for the purposes described in this Policy:

• Hosting and site operations: WordPress.com/Automattic, content-delivery, security, and technical providers.
• Measurement: Google Analytics through MonsterInsights and Jetpack Stats, where enabled.
• Email and forms: Kit (formerly ConvertKit) and form or customer-communication providers.
• App development and infrastructure: Infuse Medical/Infuse Media Group and providers that support authentication, hosting, databases, crash reporting, messaging, or app maintenance.
• App stores and payments: Apple, Google, and other payment or distribution platforms that process transactions and entitlements.
• Professional advisers: lawyers, accountants, auditors, insurers, and similar advisers under appropriate duties of confidentiality.
• Legal and safety recipients: authorities or other parties when reasonably necessary to comply with law, protect rights or safety, prevent fraud, or respond to valid process.
• Business transactions: a prospective or actual buyer, investor, successor, or adviser involved in a merger, financing, restructuring, or transfer, subject to appropriate safeguards.

Sale and targeted advertising

We do not sell personal information for money. We do not knowingly use personal information collected in POCUS Simulator for cross-context behavioral advertising. Website analytics disclosures can be treated as a “sale,” “sharing,” or targeted advertising under some state laws depending on configuration and provider contracts. Where applicable, we provide and honor legally required opt-out methods and recognized browser signals.

6. Cookies, analytics, and similar technologies

Our website uses cookies and similar technologies. Current website code includes the following categories:

You can block or delete cookies through your browser. Blocking essential technologies may affect functionality. Where a consent tool is available, use it to manage non-essential categories. You may also use the Google Analytics browser opt-out tool.

Some browsers send “Do Not Track” or Global Privacy Control signals. Do Not Track is not a uniform standard. We process legally recognized opt-out signals, including GPC, where required by applicable law.

7. Retention and deletion

We retain personal information only for as long as reasonably necessary for the purpose collected, including to keep an account active, provide purchased access, maintain learning progress, support users, secure the Services, comply with law, resolve disputes, and enforce agreements.

Retention periods vary by data type. We consider the account lifecycle, user choices, legal or tax requirements, limitation periods, fraud and security needs, provider backup cycles, and whether information can be deidentified. When information is no longer needed, we delete, deidentify, or securely dispose of it. Limited copies may remain temporarily in protected backups or where retention is legally required.

To request deletion, use an in-app account-deletion control if available or email contact@ultrasoundfanatic.com. We may verify your request. Deleting an account does not automatically cancel a subscription managed by Apple or Google.

8. Security

We use administrative, technical, and organizational safeguards designed for the nature of the information and our Services. These may include encrypted transmission, access controls, authentication protections, provider due diligence, monitoring, backups, and data minimization. No system is completely secure, and we cannot guarantee absolute security.

If you believe your account or information may be at risk, contact us promptly and do not include patient data in your message.

9. Your choices and privacy rights

Depending on where you live and subject to legal exceptions, you may have rights to:

• know, access, or receive a portable copy of personal information;
• correct inaccurate personal information;
• delete personal information;
• restrict or object to certain processing;
• opt out of sale, sharing, targeted advertising, or certain profiling;
• withdraw consent where processing relies on consent;
• appeal a denied request where local law provides an appeal; and
• receive equal service and not be discriminated against for exercising privacy rights.

Submit a request to contact@ultrasoundfanatic.com and describe the right you want to exercise. We may ask for information reasonably necessary to verify identity and authority. An authorized agent may submit a request where permitted by law, but we may require proof of authorization.

You can unsubscribe from marketing emails using the link in any message. We may still send non-promotional account, purchase, security, or policy notices.

10. Regional privacy notices

United States

Residents of California and other states may have the access, correction, deletion, portability, opt-out, appeal, and non-discrimination rights described above when the applicable law covers our processing. The categories of information, sources, business purposes, and recipient categories are described in Sections 2–6. We do not knowingly sell or share personal information of consumers under 16.

European Economic Area, United Kingdom, and Switzerland

Where these laws apply, we process personal data under one or more legal bases: performance of a contract (to provide requested Services), legitimate interests (to operate, secure, analyze, and improve the Services), consent (for optional cookies or marketing where required), and legal obligation.

Information may be transferred to and processed in the United States and other countries that may have different data-protection laws. Where required, we rely on approved contractual safeguards, adequacy decisions, or another lawful transfer mechanism. You may request information about applicable safeguards.

You may complain to the data-protection authority where you live or work. We encourage you to contact us first so we can try to resolve the issue.

11. Children’s privacy

The Services are intended for a general audience of ultrasound learners and professionals and are not directed to children under 13. We do not knowingly collect personal information from a child under 13 without legally required parental authorization. If you believe a child provided personal information contrary to this Policy, contact us so we can investigate and take appropriate action.

Users under the age of legal majority should use the Services only with involvement of a parent or legal guardian.

12. Third-party links and services

Links to third-party sites and services are provided for convenience and education. Their privacy practices are controlled by them, not by this Policy. Review their notices before providing personal information.

13. Changes to this Policy

We may update this Policy as our Services, providers, or legal obligations change. We will post the updated version, revise the date above, and provide additional notice when required. Material changes apply prospectively from their stated effective date.
